Additional Terms & Conditions of Sale
These Additional Terms apply in conjunction with James Hargreaves (Plumbers Merchants) Ltd (the Company) Standard Terms and Conditions of Sale and should be read together. 1. Product Types
1.1 Standard Products – Products that are normally held in stock and available for immediate purchase.
1.2 Special Products – Non-stocked products that are custom-made or specially ordered to the Customer’s specifications, making them unique and not easily resold to another customer.
2. Order Confirmation, Deposits, and Payments
2.1 A 25% deposit is required to confirm the Sales Order. By paying the deposit, the Customer authorises the Company to source the products listed on the Sales Order on their behalf.
2.2 Deposits are non-refundable, except where the Company cancels the order, fails to deliver as agreed, or the product is faulty or not as described.
2.3 The remaining balance must be paid in full before delivery or collection.
3. Cancellations and Returns
3.1 Standard Products – Returnable within 30 days of the Sale, provided the product is unused, in its original packaging, and in a resaleable condition.
3.2 Special Products – Cancellations are allowed within 48 hours of order confirmation, subject to any costs incurred by the Company. Special Products are non-returnable unless defective, not of satisfactory quality, or not as described. However, if the supplier of the Special Product accepts a return, a credit will be issued subject to any applicable restocking fee charged by the supplier.
3.3 Any refund, where applicable, will be issued only after product inspection.
3.4 The cost of returning the product is the responsibility of the Customer unless the product is faulty, not of satisfactory quality, or not as described.
4. Delivery and Collection
4.1 Orders must be collected or delivered within 12 weeks of order confirmation. Storage fees may apply beyond this period.
4.2 One free local delivery is offered (restrictions apply). Additional deliveries may incur charges.
4.3 Deliveries are to the kerbside only. The Customer is responsible for moving the products inside their property.
4.4 The Customer is responsible for ensuring that an individual aged 18 or over is present to sign for the delivery. Redelivery may incur an additional fee.
4.5 It is recommended that a plumber or fitter be on-site to inspect the products upon delivery.
4.6 Any issues (damages, shortages, or incorrect products) must be reported within 48 hours of delivery or collection.
5. Deferred Delivery and Storage Fees
5.1 Customers are responsible for collecting or arranging delivery of their orders within 12 weeks of order confirmation.
5.2 If this does not occur, storage fees may be charged. An initial fee of 10% of the order value may apply, with a further 5% for every additional 4-week period, or part thereof, that the goods remain uncollected.
5.3 The Company reserves the right to sell uncollected goods after a reasonable period to recover storage and related costs. Any remaining balance, after deductions, will be credited to the Customer.
6. Guarantee and Warranty
6.1 All products come with a 12-month guarantee against manufacturing defects. Manufacturer warranties are provided where applicable.
6.2 Ex-display products have a 12-month guarantee only and may have limited warranty coverage, which will be specified at the point of sale.
6.3 Any claims for faulty products must be made within the warranty period and will be processed according to the manufacturer’s assessment procedures.
7. Liability
7.1 The Company is not liable for indirect or consequential losses, except where such exclusion is prohibited under applicable laws. This includes but is not limited to, losses arising from delays, incorrect deliveries, installation issues, third-party installation costs, or issues resulting from delayed or faulty products.
7.2 The Customer is responsible for ensuring that products meet their requirements before purchase.
8. Force Majeure
8.1 The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, government actions, supply chain disruptions, or unforeseen shortages of materials or labour.
8.2 If such events occur, the Company will notify the Customer and make reasonable efforts to fulfil the order as soon as possible.
9. Severability
9.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, it will be modified to the minimum extent necessary to be valid and enforceable.
9.2 If modification is not possible, the provision will be removed, but the remainder of these Terms and Conditions will continue in full force and effect.
10. Governing Law and Dispute Resolution
10.1 These terms shall be governed by and construed in accordance with the laws of England and Wales.
10.2 Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
